These Terms of Use  apply to your use of the Esculap-med.com portal and its affiliates (referred to collectively as “Esculap-med.com,” “Esculap-med,” “Esculap-med portal”  “us,” “we” and “our”) that are intended for use by healthcare professionals,  including the information and services made available to users of the Esculap-med.com such as medical news, reference content, clinical tools, applications, sponsored programs, advertising, email communications, continuing medical education, market research opportunities and discussion forums (collectively, the “Services"). You will always be able to view the most current version of these Terms by clicking on the Terms of Use link at the bottom of any page of Esculap-med.com property. Note that these Terms do not apply to our properties and services that display a link to different terms of use.

In case of sponsored content, messages or materials, a clear statement will be displayed in the header or footer confirming that the content is sponsored, funded, placed, positioned or otherwise commercially funded – along with the source and nature of that funding.

By using the Services, you agree to these Terms, whether or not you are a registered member of the Esculap-med.com portal. These Terms govern your use of the Services and create a binding legal agreement that we may enforce against you in the event of a violation. If you do not agree to all of these Terms of Use, do not use the Services!

Esculap-med.com portal is a web property of SIA Vivanti Europe. The registered and business address of SIA Vivanti Europe is at Bauskas street 58A Riga LV1004, Latvia.

By accessing any part of the service you acknowledge that information relating to you and your access, including behavior patterns and in some instances personally identifiable information may be shared within our organization (its subsidiaries, divisions, related entities and affiliates) regardless of the service element you have accessed or its provider. On an anonymized basis this same information – or parts thereof – may also be stored, referenced and used by third parties whose services support or form a component of this service. These include third parties such as Google Analytics or an advertising service operated by Google .

In general, the purpose of collecting such information is to help us better measure, analyze, understand and serve the needs of our users with appropriate content.

In addition to Esculap-med.com portal Services, some service elements are also may be provided under license or by way of other agreement by related businesses with another organizations.  Where that is the case, these terms of use and Privacy Policy shall prevail.

  1. Intended audience – healthcare professionals

    By accessing this service, you are confirming your status as a medical doctor, physician, nurse, clinical specialist or otherwise qualified healthcare professional.

    This service is intended for use by healthcare professionals only. Non-professionals or those not possessing a nationally - or internationally- recognized medical qualification should review information carefully with their professional healthcare provider. The information is not intended to replace medical advice offered by doctors, physicians or other qualified healthcare professionals.

    We do not knowingly collect or maintain personal information from any person under the age of eighteen.

    As you must register an account to access all of the Esculap-med services and provide us with your name, email address, profession, specialty and other information specified in the registration form, you agree that your Registration Information is true, accurate, current, and complete, and you will promptly update your Registration Information as necessary so that it continues to be true, accurate, current and complete.  Please refer to our Privacy Policy to understand how we use and protect this information.

    Furthermore, by accessing the service, you confirm you understand that the content contained herein is made available for an international audience and that the presentation of the service or its content in a local language does not imply a warranty or guarantee from the service provider as to the accuracy or applicability of the content or service for a given region, country or language.

    For country-specific prescription drug information and guidance please consult local health authorities or medicines agencies. Pharmaceutical product licensing, approval, availability and prescribing information, treatment guidelines, and other clinical parameters may vary from one country to another.

  2. Accuracy and use of content contained

    We make every effort to ensure the accuracy of content presented through these services.     The service provider, our sponsors, advertisers and partners do not accept responsibility for content held within external websites linking to or from this service. The content of any such website in no way represents the opinions of the service provider.     Except as expressly permitted by applicable law or as authorized by us or the applicable licensor, you agree not to modify, rent, lease, loan, sell, distribute, transmit, broadcast, publicly perform, create derivative works from, or "scrape" for commercial or any other purpose thу content or software, in whole or in part.,  Any permitted use of information from the service should be accompanied by an acknowledgement of the service provider and a clear credit to Esculap-med.com  as the source, citing the uniform resource locator (URL) of the relevant page within this service. You may view information provided through the services of Esculap-med portal online, download individual articles to your computer or mobile device for later reading or print a copy of an article for yourself. You may not remove any copyright notices from our materials. You agree not to access the Services by any means other than through the interface that is provided by us for use in accessing the Services.

    It is strictly forbidden to use the service imagery, the Esculap-med.com or Vivanti logos or related graphics without authorisation in writing. Where permission has been granted, the Esculap-med.com or Vivanti logo must be hyperlinked to the Esculap-med homepage (www.esculap-med.com) or LLC Vivanti (www.vivanti.eu) respectively.   6. User-generated content

    Certain services enable users to submit content which may include, without limitation, text, images, photographs, figures, charts, graphics, reports, data and sound ("User Content"). User Content does not include Registration Information. When you submit User Content through the Esculap-med services you automatically grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid up, transferable, sub-licensable (through multiple tiers) license to distribute, transmit, copy, host, publicly display and perform, excerpt, index, tag, modify, adapt, sell, create derivative works from, and otherwise use and exploit such User Content in any media, form or format now known or hereafter developed, both within and outside of the Esculap Site for any purpose that is consistent with the Esculap Privacy Policy. You agree that you are solely responsible for all User Content that you submit through the Services. You represent and warrant that you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents and releases that are necessary to grant to us the rights in such User Content as specified in these Terms.By using the site you agree you will not upload or transmit any communications or content that infringes or violates any rights of any party. Submission of content to the site is an agreement that the submission is non-confidential for all purposes. You agree to only post or upload media (including but not limited to photos, graphics, videos or audio) that you have taken yourself or that you have all rights to transmit and license and do not violate trademark, copyright, privacy or any other rights of any other person. You agree that you will not submit any media that contains Personally Identifiable Information of any kind, including case material that may permit identification of a patient. Uploading media such as images or video of other people without their permission is strictly prohibited.

    By uploading any media to the site, you warrant that you have permission from all persons appearing in your media for you to make this contribution and grant rights described herein. Never post a picture or video of (or with) someone else unless you have their explicit permission. It is strictly prohibited to upload media of any kind that contain expressions of hate or abuse, offensive images or conduct, obscenity, pornography, sexually explicit content or any material that could give rise to civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with the Terms of Use or Privacy Policy.

    You agree that you will not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or Esculap-med portal. The service provider reserves the right to review all media prior to submission to the site and to remove any media for any reason, at any time, without prior notice, at our sole discretion.

The service provider and its licensors, advertisers, suppliers or other third parties are not responsible for the consequences of any communications you create on the service.

The service provider has the right to disable any login password without prior notice whether chosen by you or allocated by us at any time if, in the service provider’s opinion, you have failed to comply with any of the provisions of these Terms of Use or if the service provider determines that it is necessary for the service provider to do so for any reason.     By registering as a user of Esculap-med portal you accept that you may occasionally receive promotional and non-promotional correspondence from us.

    This correspondence may also include information or messages sponsored, written or paid for by third party/pharmaceutical/medical device companies or others with a commercial or scientific agenda. As such, these messages may contain sponsored or advertising content related to pharmaceutical products, devices, brands or websites. Where this is the case, the message or part thereof will be clearly marked as 'sponsored' or ‘promotional’.

  10. Personal data use (briefly)

    The Esculap-med Privacy Policy provides information about our collection, use and disclosure of information about users of the Esculap-med services. By accessing and using the services, you agree to the terms of the Privacy Policy and acknowledge and agree that the Privacy Policy forms an integral part of these Terms.
